These Terms and Conditions (“Terms”) apply to all services, programs, products, and content provided by Sapling Minds (“Sapling Minds”, “we”, “us”, or “our”), including but not limited to coaching programs, workshops, retreats, speaking engagements, digital products, and online content.
By accessing the Sapling Minds website, enrolling in a program, purchasing a product, or engaging our services, you agree to be bound by these Terms.

In these Terms and Conditions, the following terms have the following meanings:

"Services" refers to the programs, coaching, workshops, speaking engagements, retreats, and other services provided by Sapling Minds.

"Products" refers to any physical or digital items, including but not limited to books, offered for sale through our website.

"You," "Your," "User" refers to you, the person or entity accessing or using our website and services.
1. Introduction
By booking, enrolling, purchasing, or otherwise engaging with Sapling Minds, you confirm that you have read, understood, and agree to these Terms, together with any applicable program-specific disclaimers, privacy policies, and enrolment conditions.
Where required, acceptance may be obtained via an explicit acknowledgement (for example, by ticking a checkbox or submitting an enrolment form).
2. Nature of Services
Sapling Minds provides preventative, educational, and developmental wellbeing services.
Our services are not clinical, therapeutic, counselling, psychological, or medical services and do not diagnose, treat, or replace professional healthcare or mental health support.
Participation in any Sapling Minds service should not be considered a substitute for professional advice, diagnosis, or treatment. If you have concerns about your own or your child’s mental health or wellbeing, you should seek support from a qualified health professional or emergency services where appropriate.
3. Use of Our Website
By accessing and using our website, you agree to the following:

You will not use our website for any unlawful or fraudulent activities.

Certain programs (including but not limited to the Foundations Program™ and Inner Voice Reset™) are governed by additional program-specific disclaimers.
Where there is any inconsistency between these Terms and a program-specific disclaimer, the program-specific disclaimer will prevail.
6. Participant and Parent Responsibilities
Adult Participants
Participants engaging in adult-focused services remain responsible for their own wellbeing during and after sessions and for seeking external professional support where required.
Children’s Programs
For programs involving children, parents or legal guardians remain responsible for their child’s wellbeing during and outside program sessions and for providing accurate, complete, and relevant information about their child.
Sapling Minds relies on information provided by participants and parents and is not responsible for outcomes arising from incomplete, inaccurate, or withheld information.
7. Bookings, Cancellations, and Refunds
Bookings
When you book a service, you are entering into a binding agreement to pay for that service. We accept payment via credit card, debit card, and other secure online payment methods. Payment for services must be made in full before the service is provided, unless otherwise agreed.
Cancellations and Refunds
Cancellation and refund policies for services and products are outlined at the time of booking or purchase and may vary by offering.
Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any rights or remedies you may have under the Australian Consumer Law (ACL).
Where services fail to meet a consumer guarantee under the ACL, you may be entitled to a remedy regardless of any cancellation or refund policy stated by Sapling Minds.
8. Digital Products and Resources
Digital products, downloads, and online materials are provided for personal use only. Access may be time-limited or ongoing as specified at the time of purchase.
Refunds for digital products are generally not provided for change of mind, subject always to your rights under the Australian Consumer Law (ACL).
9. Intellectual Property
All content, materials, frameworks, methodologies, program names, trademarks, videos, written resources, and intellectual property provided by Sapling Minds remain the exclusive property of Sapling Minds unless otherwise stated.
You may not reproduce, distribute, modify, resell, or commercially exploit any Sapling Minds materials without prior written consent.
10. International Use and Compliance with Local Laws
Our services and products are available to users globally. By using our website and services, you agree to comply with all applicable laws and regulations in your country of residence or the jurisdiction in which you are accessing our website. You are responsible for ensuring that your use of our services and products complies with any local laws, including but not limited to consumer protection, data privacy, and child protection laws.
11. International Shipping and Fees
We currently offer international shipping to select countries. Additional shipping charges and customs duties may apply, depending on your location. Please note that we are not responsible for any delays or additional costs incurred due to customs processes in your country.
12. Privacy and Data Handling
Personal information is collected, stored, and used in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

13. Photography, Video, and Media
Where photography or video recording occurs, consent will be obtained as part of enrolment or engagement. Use of images will be consistent with the stated purpose and relevant privacy laws.
Consent may be withdrawn in writing; however, previously published materials may not be able to be fully removed.
14. Force Majeure
We are not liable for any failure or delay in providing our services due to events beyond our reasonable control, including but not limited to natural disasters, pandemics, government restrictions, or other unforeseen circumstances.
15. Duty of Care and Safety
Sapling Minds is committed to providing a safe, respectful, and supportive environment during scheduled program activities under our supervision.
Our duty of care does not extend beyond scheduled sessions or activities, nor does it extend to decisions made by participants or parents based on program learnings.
Sapling Minds does not provide crisis intervention or emergency services.
16. Dispute Resolution
If a dispute arises, the parties agree to first attempt to resolve the matter in good faith through informal discussion.
If the dispute cannot be resolved, either party may propose mediation before commencing legal proceedings, except where urgent relief is required.
17. Data Protection
For users located in the European Union or other regions with data protection laws, we comply with the General Data Protection Regulation (GDPR). By using our services, you consent to the collection, use, and processing of your personal data in accordance with our Privacy Policy, which outlines your rights under the GDPR, including the right to access, correct, or delete your personal data.
18. Governing Law
These Terms are governed by the laws of Australia, and the parties submit to the exclusive jurisdiction of the courts of the Australian Capital Territory.
19. Indemnity
You agree to indemnify, defend, and hold harmless Sapling Minds, its directors, officers, employees, agents, and affiliates from and against any claims, liabilities, damages, costs, and expenses, including legal fees, arising out of your use of our website, services, or products.
20. Limitation of Liability
To the fullest extent permitted by law (including the Australian Consumer Law), Sapling Minds’ liability for any loss or damage arising in connection with our services or products is limited to, at our discretion:

the re-supply of the relevant service; or

a refund of the amount paid for the service or product.
This clause does not exclude liability for rights that cannot be excluded under Australian law.
21. Insurance
Sapling Minds maintains appropriate public liability and professional indemnity insurance in connection with its services.
22. Severability
If any provision of these Terms and Conditions is deemed invalid or unenforceable, the remaining provisions will remain in full effect.
23. Changes to These Terms
Sapling Minds reserves the right to amend these Terms at any time. Updated versions will be published on our website with a revised effective date.
Continued use of our services after changes take effect constitutes acceptance of the updated Terms.
